WAKAJUGBE RIDER TERMS AND CONDITIONS

Welcome to Wakajugbe (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use as a rider (“you,” “Rider”) of our ride-hailing services (the “Services”) made available through our website, mobile applications (“App”), and any other platforms under our control that reference these Terms.

By accessing or using the Services, you agree to be bound by these Terms, including any additional terms and policies (e.g., Privacy Policy) referenced herein. If you do not agree with these Terms, do not use the Services.

1. Definitions

1.1. “Account” means your unique Rider account created upon registration to use the Wakajugbe platform.

1.2. “Driver” means the independent, third-party driver or vehicle operator who provides transportation services via the Wakajugbe platform.

1.3. “Fare” means the amount charged for each completed ride, including applicable taxes, fees, surcharges, tolls, or promotional discounts.

1.4. “Platform” means the Wakajugbe website, mobile application(s), and technology infrastructure facilitating ride requests and communications between Riders and Drivers.

1.5. “Trip” means any ride or transportation service requested by a Rider and accepted by a Driver through the Wakajugbe platform.

2. Eligibility

2.1. Age Requirement

You must be at least 18 years of age (or the legal age in your jurisdiction) and capable of entering into a binding contract to use the Services. If you are under 18 or not legally permitted to form binding contracts, you are not permitted to use Wakajugbe’s Services.

2.2. Compliance with Laws

By using the Services, you represent and warrant that you will comply with all applicable laws, regulations, and ordinances related to your use of the Services.

2.3. Accurate Information

You agree to provide and maintain accurate and up-to-date information in your Account. We are not responsible for any losses or damages arising from false or outdated personal information you provide.

3. Account Registration and Security

3.1. Account Creation

To use the Services, you must create an Account by providing personal details such as your name, phone number, email address, and, if applicable, a valid payment method.

3.2. Account Responsibility

You are responsible for all activities that occur under your Account. You must keep your Account credentials confidential and not share them with third parties. If you suspect unauthorized access to your Account, you must notify us immediately at info@wakajugbe.com or via in-app support.

3.3. Multiple Accounts Prohibited

You may not register more than one Rider Account without our explicit permission. We reserve the right to deactivate or suspend any duplicate or suspicious accounts.

3.4. Account Verification

We may verify the information you provide (including identity checks) to ensure the security of the Platform and prevent fraudulent activity. By using the Services, you consent to such verification.

  1. The Services

4.1. Service Overview


Wakajugbe operates a technology platform that enables you to request transportation services (“Trip”) from independent Drivers. We are not a transportation carrier; Drivers are independent third-party contractors who use the Platform to offer their transportation services.

4.2. No Guarantee of Availability

We do not guarantee that a Driver will be available to accept your Trip request at any given time. Driver availability may vary depending on factors such as location, demand, and external conditions (e.g., weather, traffic).

4.3. Service Modifications


We reserve the right to modify, suspend, or discontinue the Services, in whole or part, temporarily or permanently, at any time without notice and without liability to you.

5. Ride Requests and Bookings

5.1. Placing a Ride Request


When you request a ride through the Platform, the request is transmitted to nearby Drivers. A Driver may accept or decline your request at their discretion.

5.2. Ride Acceptance


Once a Driver accepts your ride request, you will receive a confirmation via the App, which includes Driver details (e.g., name, vehicle model, license plate number, vehicle colour, driver’s image) and an estimated time of arrival.

5.3. Pickup and Drop-off Location


You are responsible for inputting the correct pickup and drop-off addresses. We are not liable if a Driver cannot locate you due to an incorrect or incomplete address.

5.4. Driver-Related Issues


If you cannot locate your Driver or experience any other issue (e.g., Driver refuses to provide service, Driver misconduct, etc.), please use the in-app support function or contact customer support at info@wakajugbe.com

6. Fares, Payment, and Promotions

6.1. Fare Calculation


Fares are calculated based on various factors such as distance, time, traffic, dynamic pricing (e.g., surge pricing), and tolls. The final Fare will be displayed at the end of the Trip, unless pre-calculated before the Trip commences. Fares may only vary if additional time is spent in traffic along the route.

6.2. Payment Method


You must have a valid payment method (credit card, debit card, mobile wallet, etc.) linked to your Account. By providing a payment method, you represent that you are authorized to use it and authorize Wakajugbe to charge the Fare to that method.

6.3. Promotional Codes


We may, at our discretion, offer promotional codes or discounts subject to specific terms. Promotional codes cannot be redeemed for cash, may expire, and are void if transferred or sold.

6.4. Receipts


After completing a Trip, you will receive a digital receipt via the App summarizing the Fare, any applicable taxes, fees, or surcharges.

6.5. Disputed Charges


If you dispute a Fare or believe you were charged in error, please contact us with the provided in-app support within 7 days of incurring the charge. We reserve the right to determine in good faith whether to issue a refund.

7. Cancellations and No-Shows

7.1. Rider Cancellations


You may cancel your ride request prior to pickup; however, a cancellation fee may be charged if you cancel after a Driver has already been en route for a certain amount of time, as set forth in our cancellation policy.

7.2. Driver Cancellations


Drivers are free to cancel accepted requests in certain circumstances (e.g., Rider is not at pickup location, Rider misconduct). We are not liable for any losses if a Driver cancels your Trip.

7.3. No-Show Fees


If you do not appear at the designated pickup location within a specified grace period (e.g., 5 minutes) and do not communicate with the Driver, you may be charged a no-show fee.

  1. Rider Conduct and Responsibilities

 

8.1. Prohibited Conduct


You agree not to:

  • Violate any laws or regulations in connection with your use of the Services.
  • Harm or threaten the Driver or other passengers.
  • Use the Platform for illegal, fraudulent, or unauthorized purposes.
  • Provide false information during registration or when using the Services.
  • Harass, abuse, or threaten others or engage in obscene, offensive, or violent behavior.

8.2. Property Damage


You are responsible for any damage to the Driver’s vehicle or property caused by you or your guests (e.g., spilling food, breaking a seat or window). Additional cleaning or repair fees may apply.

8.3. Minors


If you are arranging a ride for a minor, you must abide by all applicable laws regarding child safety seats and ensure the child’s safety during the Trip. Minors must be accompanied by an adult unless otherwise permitted by law.

  1. Lost and Found

 

9.1. Personal Belongings


You are responsible for your personal belongings during the Trip. Neither Wakajugbe nor the Driver is liable for items left behind in a vehicle.

9.2. Lost Item Retrieval


If you leave an item in a Driver’s vehicle, contact the driver or customer support or use the in-app function. We will attempt to coordinate the return of the item, but we are not responsible for any lost, stolen, or damaged items.

10. Intellectual Property

10.1. Wakajugbe Content


All content, trademarks, service marks, databases, logos, and other intellectual property displayed through the Platform are the property of Wakajugbe or its licensors. You are granted only a limited, revocable, non-exclusive license to use the Services in accordance with these Terms.

10.2. User Feedback


By submitting feedback or suggestions about the Services, you grant Wakajugbe a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate such feedback into our products and services.

11. Disclaimer of Warranties

11.1. As Is Basis


The Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

11.2. Third-Party Services


We do not warrant, endorse, guarantee, or assume responsibility for services provided by third parties (including Drivers). We are not liable for any loss or damage arising from transactions or interactions with third parties.

11.3. No Guarantee of Reliability


While we aim to provide a reliable and safe experience, we do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components. We will make reasonable efforts to remedy any defects but are not obligated to do so within a specific time frame.

12. Limitation of Liability

12.1. Indirect Damages Exclusion


To the fullest extent permitted by law, under no circumstances shall Wakajugbe (including its officers, directors, employees, or affiliates) be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

12.2. Aggregate Liability Cap


In no event shall our total liability for all claims arising out of or relating to these Terms or the use of the Services exceed the total amount you have paid to Wakajugbe in the three (3) months preceding the event giving rise to the claim.

12.3. State/Jurisdiction Limitations


Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

13. Indemnification

You agree to defend, indemnify, and hold harmless Wakajugbe, its affiliates, officers, directors, employees, agents, and successors from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your breach of these Terms or any policy referenced herein;
  • Your violation of any law or regulation;
  • Your infringement of any third-party right (including intellectual property or privacy rights); or
  • Your misconduct, negligence, or wrongful act in the course of using the Services.
  1. Term, Termination, and Suspension

 

14.1. Term


These Terms remain in effect for as long as you use or maintain an Account for the Services.

14.2. Termination by You


You may terminate your Account at any time by uninstalling the App and discontinuing use of the Services.

14.3. Termination or Suspension by Us


We may, at our sole discretion, suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we believe it is necessary to protect our interests or the safety of others.

14.4. Effect of Termination


Upon termination, all rights granted to you under these Terms end immediately. Any obligations or liabilities incurred by you prior to termination shall survive.

15. Dispute Resolution

15.1. Informal Resolution


In the event of a dispute, you agree to first contact us with in-app support or email info@wakajugbe.com to attempt to resolve the matter informally.

15.2. Arbitration / Court


Depending on your jurisdiction, disputes may be resolved through binding arbitration or in the courts. You agree to submit to the personal jurisdiction of the courts or arbitrators located in such jurisdiction.

15.3. Class Action Waiver


You agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Modifications to Terms

16.1. Right to Update


We reserve the right to update or modify these Terms at any time. If we make material changes, we will post a notice on our Platform or notify you via email or App notification.

16.2. Effective Date of Revisions


Your continued use of the Services after the revised Terms become effective constitutes acceptance of the updated Terms.

17. General Provisions

17.1. Entire Agreement


These Terms (including any referenced policies such as our Privacy Policy) constitute the entire agreement between you and Wakajugbe regarding your use of the Services and supersede all prior agreements or understandings, written or oral.

17.2. Severability


If any part of these Terms is held invalid or unenforceable under applicable law, that portion shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.

17.3. No Waiver


Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision herein.

17.4. Assignment


You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms or any rights hereunder at our discretion, without restriction.

17.5. Force Majeure


We shall not be liable for delays, failure in performance, or interruption of service resulting directly or indirectly from acts of nature, forces, or causes beyond our reasonable control.

17.6. Governing Law


These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria without regard to conflict-of-law principles.
